涉外案件中外國人權利保護研究
今天,我們隨同蕭先生前往法務部廉政署,旁聽了一場題為「涉外案件中外國人權益保障之研究」的律師研討會。隨著台灣經濟成長並創造了大量機遇,自2020年以來,來台外國人數量增加。然而,也有不少外國人是作為難民來到台灣的;目前,台灣並不允許外籍人士僅憑尋求庇護這一理由獲得居留權或工作許可。這種情況往往迫使他們採取非法手段謀生,並使尋求庇護者面臨被逮捕、拘留甚至遣返的風險。
今天的研討會共有四位主講人:呂以傑(Lu Yi-chieh)教授、許恆達(Hsu Heng-ta)教授、克雷波(Crépeau)教授以及許榮(Hsu Jung)教授。呂教授探討了洗錢問題,指出儘管大多數台灣本地人能避開此類詐騙陷阱,但許多外籍人士卻未能倖免,從而捲入了刑事案件。許恆達教授將遣返視為一種安全措施而非刑事處罰,並主張台灣應採取自願離境等機制,由政府承擔遣返費用,同時明確遣返令的有效期,以防止被遣返者再次非法入境。克雷波教授在問答環節提出了一個有趣的觀點:非法移民和難民已成為新的工人階級,他們理應享有勞工權益並與工會密切合作,而目前的工會在這一方面往往顯得過於保守或猶豫。最後,許榮教授提出了一個問題:行政機關應在何時介入刑事案件?
The Study on the Protection of Foreigners' Rights in Foreign-Related Cases
Today we went with Mr. Hsiao to the Anti-Corruption Bureau in the Ministry of Justice to listen in on a lawyer’s workshop called “The Study on the Protection of Foreigners' Rights in Foreign-Related Cases.” Apparently since 2020, the number of foreigners coming to Taiwan has risen, as Taiwan has been growing economically and has created many opportunities. But there are also a number of foreigners that come to Taiwan as refugees, and currently Taiwan does not allow foreign nationals to obtain residency or work authorization on the basis of seeking asylum. Oftentimes this leads to illegal means of survival, and risks asylum seekers to arrest, detention, and even deportation.
There were 4 keynote speakers today: Professor Lu Yi-chieh, Professor Hsu Heng-ta, Professor Crépeau, and Professor Hsu Jung. Prof. Lu spoke about money laundering, and how despite most native Taiwanese being able to avoid these scams, many foreign nationals do not, and they get roped up into a criminal case. Prof. Hsu talks about deportation as a security measure, rather than a criminal punishment, and argues for Taiwan to adopt things like voluntary departure, for the Taiwanese government to cover the expenses of deportation, and to specify how long a deportation order remains in effect in order to avoid unwanted re-entry. Prof. Crépeau made an interesting point during the Q&A section that illegal immigrants and refugees are now the new working class, and that they should also have workers rights and work closely with unions, in which unions currently have been too shy to do so. And Prof. Hsu Jung brought up the question of at what point do administrative agencies get involved in criminal cases?
